1. Acceptance of Terms
By creating an account or using the services provided on helpin.ge, you confirm that you are at least 18 years old and are legally capable of entering into this agreement.
2. Description of Service
Helpin.ge provides a digital marketplace platform connecting professional coaches, psychologists, and other experts (“Providers”) with individuals seeking their services (“Clients”).
- Facilitation Only: You acknowledge that helpin.ge acts only as a facilitator. We provide the tools for scheduling, communication, and payment processing, but we are not a party to any professional agreements, therapeutic relationships, or the actual provision of services between users.
- No Professional Advice: Helpin.ge does not provide medical, psychological, or any professional advice. All consultations and services are the sole responsibility of the Providers.
3. User Accounts
- Accuracy: You must provide accurate and complete information when creating an account and must keep this information updated.
- Security: You are responsible for maintaining the confidentiality of your login credentials and for all activities that occur under your account.
- Termination: We reserve the right to suspend or terminate accounts that violate these terms, engage in fraudulent or harmful activity, or for any other reason at our sole discretion.
4. Third-Party Integrations (Google Calendar & Meet)
To facilitate seamless scheduling, helpin.ge offers integration with Google Services.
- Authorization: Providers who connect their Google Calendar authorize helpin.ge to view their availability (“busy” slots) and create calendar events with Google Meet links for confirmed bookings.
- Limited Use: Our use of data from Google APIs adheres to Google’s Limited Use requirements and our Privacy Policy. We do not access the content of unrelated calendar events.
- Service Liability: helpin.ge is not responsible for the uptime, functionality, or technical failures of third-party services like Google Calendar or Google Meet.
5. Code of Conduct
Users agree not to use helpin.ge to:
- Post illegal, offensive, defamatory, threatening, or harassing content.
- Fraudulently impersonate any professional, entity, or person.
- Attempt to circumvent the platform’s payment system or facilitate transactions outside of helpin.ge.
- Upload viruses or malicious code, or engage in any activity that could disrupt or damage the platform’s infrastructure.
6. User-Generated Content
You retain ownership of the content you post (e.g., profile information, reviews). However, by posting it, you grant helpin.ge a worldwide, non-exclusive, royalty-free license to use, display, reproduce, and distribute that content for the purpose of operating and promoting the platform. We reserve the right to remove any content at our discretion.
7. Fees, Payments, Refunds, and Reversals
- Platform Fee: Helpin.ge charges a service fee for facilitating the booking and payment process. This fee is clearly displayed to the user before confirming a booking.
- Cancellation & Refund by Client: Cancellation and refund policies are set by the individual Provider and are displayed on their profile and during the booking process. The Client is obligated to review these policies before confirming a booking. General refund requests related to service quality are reviewed on a case-by-case basis upon contact with support at info@helpin.ge, but the final decision is subject to the Provider’s policy and specific circumstances.
Refund (Reversal) Initiated by the Platform: Helpin.ge reserves the right to unilaterally initiate a full or partial refund (payment reversal) to the Client in the following cases:
- Discovery of fraudulent activity by the Provider.
- A significant discrepancy between the service provided and its description on the platform.
- A gross violation of the Code of Conduct or professional ethics by the Provider.
- A technical failure of the platform leading to an erroneous charge.
- A legitimate request from a government authority or court order.
- Payouts to Providers: Funds are released to Providers according to the “Payout” schedule and terms outlined in their account dashboard, following a successfully completed session. Helpin.ge is not responsible for delays caused by partner banks or payment processors.
8. Limitation of Liability
Helpin.ge is provided on an “as is” and “as available” basis. To the maximum extent permitted by Georgian law:
- We disclaim all warranties, express or implied.
- We shall not be liable for any indirect, incidental, special, consequential, or punitive damages.
- Provider Conduct: We are not responsible for the professional conduct, quality, outcome, or legality of services provided by any Provider listed on the platform. Interactions and agreements are solely between the Client and the Provider.
9. Intellectual Property
All logos, trademarks, designs, text, graphics, and software associated with helpin.ge are the intellectual property of Helpin LLC or its licensors. You may not copy, modify, distribute, or use any of our branding or proprietary material without express written permission.
10. Governing Law and Dispute Resolution
These terms are governed by and construed in accordance with the laws of Georgia. Any disputes arising from these terms shall be primarily attempted to be resolved through mediation. If mediation fails, the dispute shall be subject to the exclusive jurisdiction of the courts of Tbilisi, Georgia.
11. Changes to Terms
We may modify these terms at any time. We will notify users of material changes via email or a prominent notice on the platform. Continued use of the platform after such changes constitutes acceptance of the new terms.
